1. Subject

These Terms and Conditions govern the sale of fiberglass racing boats, Snipe model, including related accessories and optional equipment, by the Seller to the Customer.

2. Boat Specifications

The boats are built in compliance with the Snipe Class Rules in force at the time of construction.

Any dimensional or weight tolerances fall within the limits allowed by the Class Rules and applicable regulations.

The Seller reserves the right to make non-substantial technical or material improvements that do not affect performance or class compliance.

3. Orders

An order shall be deemed confirmed only upon:

  • written acceptance of the quotation by the Customer;

  • payment of the agreed deposit, if applicable.

Any customization requests must be specified in writing at the time of order.

4. Prices

Prices are expressed in Euro, unless otherwise stated, and exclude VAT, transport, packaging, insurance, customs duties, and any additional charges, unless expressly included in the quotation.

5. Payments

Payment terms (deposit, balance, due dates) are specified in the quotation or order confirmation.

The balance must be paid prior to delivery or shipment.

Failure to comply with payment terms entitles the Seller to suspend delivery or terminate the contract.

6. Delivery Time

Delivery times are indicative and depend on production workload and material availability.

Delays do not entitle the Customer to compensation or penalties, unless otherwise agreed in writing.

7. Transport and Delivery

Unless otherwise agreed:

  • transport is at the Customer’s cost and risk;

  • the Seller’s responsibility ends upon delivery to the carrier or collection at the Seller’s premises.

Any transport damage must be claimed directly from the carrier.

8. Inspection and Acceptance

The Customer shall inspect the boat upon delivery.

Any visible defects must be reported in writing within 8 days of delivery.

Failing such notice, the boat shall be deemed accepted without reservations.

9. Warranty

The Seller provides a 12-month warranty from the date of delivery against manufacturing defects.

The warranty does not cover:

  • normal wear and tear;

  • damage caused by misuse, collisions, accidents, or unauthorized modifications;

  • use not compliant with class rules or Seller’s instructions.

The warranty is limited to repair or replacement of defective parts, at the Seller’s discretion.

10. Limitation of Liability

The Seller shall not be liable for:

  • indirect or consequential damages;

  • loss of race results, competitions, or sporting opportunities;

  • damages arising from racing activities, which inherently involve risk.

11. Ownership and Risk

Ownership shall transfer to the Customer only upon full payment of the purchase price.

Risk transfers as set out in Article 7.

12. Cancellation

In the event of order cancellation by the Customer:

  • the deposit may be retained as a penalty;

  • any costs incurred for customization shall be fully charged.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by Italian law.

Any dispute shall be subject to the exclusive jurisdiction of the Court of Trieste, unless otherwise agreed in writing.

14. Final Provisions

These Terms and Conditions form an integral part of the sales offer and contract.

Any amendments are valid only if agreed in writing.

The Customer declares to have read, understood, and accepted these Terms and Conditions of Sale.
